Terms of Service

These Terms of Service (“Terms”) govern your use of the Your Coffee Brand (“YCB”) website and services, operated by Olimpio Cafés. By using our website or submitting a sample request, you agree to these Terms. These Terms apply exclusively to business-to-business (B2B) relationships.

Article 1 — Definitions

In these Terms, the following definitions apply:

  • "YCB" / "We" / "Us" — Olimpio Cafés, trading as Your Coffee Brand (YCB), the service provider.
  • "Client" / "You" — The business entity or professional (café owner, entrepreneur) using the website or requesting services.
  • "Website" — The YCB website, including all its pages and functionalities.
  • "Services" — The white-label coffee branding and supply services offered by YCB, including the Brand Visualizer tool and free sample box program.
  • "Brand Visualizer" — The online tool that allows you to upload your logo and receive an AI-generated mockup of a coffee bag bearing your brand.
  • "Sample Box" — A complimentary package of coffee products provided for evaluation purposes.

    • Article 2 — Applicability

  • These Terms apply to all use of the Website and all requests made through it.
  • These Terms are intended for business (B2B) use. By using our Website, you confirm that you act in a professional or commercial capacity.
  • Any deviating terms or conditions of the Client are expressly rejected, unless agreed upon in writing by YCB.
  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

    • Article 3 — Service Description

    YCB offers a white-label coffee branding service for café owners and businesses in the Netherlands. Through our Website, you can:

  • Explore our service — Learn about our single-origin coffee, sourced from Fazenda Carrancas in Lavras, Minas Gerais, Brazil.
  • Use the Brand Visualizer — Upload your logo and optionally describe your preferred design to receive an AI-generated mockup of a branded coffee bag. This is a visualization tool for preview purposes only and does not constitute a product order.
  • Request a free Sample Box — Submit the lead form with your business details to receive a complimentary sample of our coffee products for evaluation.

    • The information on the Website is for general informational purposes. We make reasonable efforts to keep it accurate, but make no warranties about its completeness or timeliness.

    Article 4 — Sample Box

  • The Sample Box is provided free of charge, strictly for evaluation purposes.
  • Requesting a Sample Box does not create a binding purchase agreement, supply contract, or any other contractual obligation beyond these Terms.
  • YCB reserves the right to decline any sample request at its sole discretion, without stating reasons.
  • YCB may set conditions on sample eligibility, including but not limited to: valid business registration, location within the Netherlands, and one sample per business entity.
  • Receipt of a Sample Box does not create any obligation on either party to enter into a further commercial relationship.

    • Article 5 — Intellectual Property

    Your content:

  • You retain all intellectual property rights to logos, trademarks, and other materials you upload to the Website.
  • By uploading your logo to the Brand Visualizer, you grant YCB a limited, non-exclusive, temporary license to use the logo solely for the purpose of generating the AI mockup visualization.
  • You warrant that you own or have proper licenses to any content you upload and that it does not infringe any third-party rights.
  • You indemnify YCB against any claims arising from uploaded content that infringes third-party intellectual property rights.

    • Our content:

  • All Website content, design, text, graphics, Brand Visualizer tool, mockup templates, and coffee bag designs (excluding your uploaded logo) remain the property of YCB / Olimpio Cafés.
  • Generated mockups are provided for preview purposes only. You may not use generated mockup images for commercial purposes without entering into a formal service agreement with YCB.
  • Nothing in these Terms transfers any intellectual property rights from one party to the other unless explicitly agreed in writing.

    • Article 6 — User Obligations

    When using the Website, you agree to:

  • Use the Website for its intended purpose only — evaluating YCB's white-label coffee services
  • Provide accurate and truthful business information
  • Not upload offensive, illegal, or infringing content
  • Not attempt to reverse-engineer, scrape, copy, or otherwise misuse the Brand Visualizer or any part of the Website
  • Not use automated tools (bots, scrapers) to interact with the Website
  • Submit no more than one Sample Box request per business entity

    • Article 7 — Data Protection

    We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR / AVG) and the Dutch Uitvoeringswet AVG.

    By using the Website and submitting the lead form, your data is processed as described in our Privacy Policy.

    Article 8 — Limitation of Liability

  • The Website and Brand Visualizer are provided "as is" without warranties of any kind, express or implied. We do not guarantee the accuracy of mockup color representations, uninterrupted availability, or error-free operation of the Website.
  • YCB shall not be liable for any indirect, consequential, or special damages, including but not limited to: lost profits, business interruption, loss of data, or reputational damage.
  • If YCB is found liable for any direct damages, our total liability shall be limited to €500 (five hundred euros), given the free-of-charge nature of the sample service.
  • The limitations above do not apply to damages caused by intent (opzet) or gross negligence (bewuste roekeloosheid) on the part of YCB, in accordance with Dutch law.

    • Article 9 — Force Majeure

    YCB is not liable for failure or delay in performing its obligations if such failure or delay results from circumstances beyond its reasonable control, including but not limited to: supply chain disruption, natural disasters, pandemics, government measures, internet or telecommunications failures, or raw material shortages.

    During a force majeure event, YCB's obligations are suspended. If the event continues for more than 90 days, either party may terminate these Terms with respect to the affected obligations.

    Article 10 — Modification of Terms

  • YCB reserves the right to modify these Terms at any time.
  • Updated Terms will be published on this page with a new "Last updated" date.
  • Continued use of the Website after modification constitutes acceptance of the updated Terms.
  • For material changes that significantly affect your rights, we will make reasonable efforts to provide advance notice.

    • Article 11 — Governing Law and Disputes

  • These Terms are governed by and construed in accordance with Dutch law (Nederlands recht).
  • The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
  • Any disputes arising from or in connection with these Terms shall be submitted to the competent court in the district where Olimpio Cafés is registered in the Netherlands.
  • Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation.
